Palm Island in Dubai

The Palm Islands are artificial islands in Dubai, United Arab Emirates on which major commercial and residential infrastructure will be constructed. They are being constructed by Nakheel Properties, a property developer in the United Arab Emirates, who hired Belgian and Dutch dredging and marine contractor Jan De Nul and Van Oord, some of the world's specialists in land reclamation. The islands are the Palm Jumeirah, the Palm Jebel Ali and the Palm Deira. Each settlement will be in the shape of a palm tree, topped with a crescent, and will have a large number of residential, leisure and entertainment centers. The Palm Islands are located off the coast of The United Arab Emirates in the Persian Gulf and will add 520 kilometres of beaches to the city of Dubai. The first two islands will comprise approximately 100 million cubic meters of rock and sand. Palm Deira will be composed of approximately 1 billion cubic meters of rock and sand. All materials will be quarried in the UAE. Among the three islands there will be over 100 luxury hotels, exclusive residential beach side villas and apartments, marinas, water theme parks, restaurants, shopping malls, sports facilities and health spas. The creation of the Palm Jumeirah began in June 2001. Shortly after, the Palm Jebel Ali was announced and reclamation work began. The Palm Deira, which is planned to have a surface area of 46. 35 square kilometres, was announced for development in October 2004. Construction was originally planned to take 10–15 years, but that was before the impact of the global credit crunch hit Dubai. The Palm Islands are artificial peninsulas constructed of sand dredged from the bottom of the Persian Gulf by the Belgian company Jan De Nul and the Dutch company Van Oord. The sand is sprayed by the dredging ships, which are guided by DGPS, onto the required area in a process known as rainbowing because of the arcs in the air when the sand is sprayed. The outer edge of each Palm's encircling crescent is a large rock breakwater. The breakwater of the Palm Jumeirah has over seven million tons of rock. Each rock was placed individually by a crane, signed off by a diver and given a GPS coordinate. The Jan De Nul Group started working on the Palm Jebel Ali in 2002 and had finished by the end of 2006. The reclamation project for the Palm Jebel Ali includes the creation of a four-kilometre-long peninsula, protected by a 200-metre-wide, seventeen-kilometre long circular breakwater. 210,000,000 m3 of rock, sand and limestone were reclaimed (partly originating from the Jebel Ali Entrance Channel dredging works). There are approximately 10,000,000 cubic metres of rocks in the slope protection works. The first thing comes to my mind about all the wonders of the world is the amazing ability of the engineers and architects involved in their constructions to come out with something which finally turns to wonder of the world. I also think that they might be built to let people from all around the world know about the country or state where they are situated. Let us take Dubai as an example. This UAE state became so significant when we talk about superb modern construction since the launching of it's famous Burj Al-Arab, a luxurious 7-star rated hotel. Then the name of Dubai continuously becoming well-known with numbers of modern constructions especially the unbeaten world's tallest building, the 162-stories Burj Khalifa with 828-meter height which is almost twice the height of our Petronas Twin Tower, and also the unbelievable Palm Ireland. The Palm Ireland project was firstly thought as something impossible by some groups of people but the credibilities of the project planners are now proven with its accomplishment. The amazing ideas of constructing these crazy stuffs had drastically brought Dubai to world's attention and this is a big bonus to it's tourism sector. Hence, wonders of the modern world can be said as the tourist attraction to the country or state where they are situated. However, sometimes I do feel that it's such a tragic obsession when Islamic countries and states like Malaysia and the famous Dubai are spending too much money on these constructions while Muslims in many regions of the world are suffering from the violence of the Jews. So, I think it should be a limit for these crazy projects and let us start focusing the nation's wealth to show our concern to Palestinians and all discriminated Muslims from various countries.

Facebook Manic Essay

Facebook is a social networking service launched in February 4, 2004, owned and operated by Facebook, Incorporated. The name of the service stems from the colloquial name for the book given to students at the start of the academic year by some university administrations in the United States to help students get to know each other. Facebook was founded by Mark Zuckerberg with his college roommates and fellow Harvard University students Eduardo Saverin (business aspects), Andrew McCollum, (graphic artist), Dustin Moskovitz (programmer), and Chris Hughes. According to The Harvard Crimson, the site was comparable to â€Å"Hot or Not† and used photos compiled from the online facebooks of nine houses, placing two next to each other at a time and asking users to choose the ‘hotter’ person. The website’s membership was initially limited by the founders to Harvard students, but was expanded to other colleges in the Boston area, the Ivy League, and Stanford University. It gradually added support for students at various other universities before opening to high school students, and eventually to anyone aged 13 and over. Facebook has affected the social life and activity of people in various ways. With its availability on many mobile devices. Marketing Management paper Essay

Questions: 1. Explain how Marketing affects the outcome of the financial equation: Sales-Expense=Profit. What risk the company might be facing in this equation with regards to marketing? Expound on the importance of marketing in sustaining business growth. (5 points.) In the equation, Sales-Expense=Profit, activities done in Marketing can be said or considered as marketing expenses that includes advertising costs, promotions, PR events and Marketing Research costs (e.g. FGD, etc.). Through the income statement, we can get the Profit or Revenue and costs or expenses. These may include the costs of marketing the product or services with other costs that is deducted from the amount of sales or total sales. The idea is to increase the revenue while costs are incurred through marketing activities. However, in order to achieve this, marketing activities must be done effectively and the costs or expenses should be managed correctly in order to create good results. Marketing activities that are not managed properly may incur additional costs to the company and continue on to increase. This is especially applicable to companies with different product portfolios and margins, wherein they can incur losses once the profitability of a product decreases. Read more:  What is New Public Management? 2. Why do companies resort to market segmentation? Explain why or how segmentation can be an effective market entry/penetration strategy. Give an example not discussed in the class. (10 points) Better matching of customer needs Customer needs differ. Creating separate offers for each segment makes sense and provides customers with a better solution. Enhanced profits for business Customers have different disposable income. They are, therefore, different in how sensitive they are to price. By segmenting markets, businesses can raise average prices and subsequently enhance profits Better opportunities for growth Market segmentation can build sales. For example, customers can be encouraged to â€Å"trade-up† after being introduced to a particular product with an introductory, lower-priced product Retain more customers Customer circumstances change, for example they grow older, form families, change jobs or get promoted, change their buying patterns. By marketing products that appeal to customers at different stages of their life (â€Å"life-cycle†), a business can retain customers who might otherwise switch to competing products and brands Target marketing communications Businesses need to deliver their marketing message to a relevant customer audience. If the target market is too broad, there is a strong risk that (1) the key customers are missed and (2) the cost of communicating to customers becomes too high / unprofitable. By segmenting markets, the target customer can be reached more often and at lower cost Gain share of the market segment Unless a business has a strong or leading share of a market, it is unlikely to be maximizing its profitability. Minor brands suffer from lack of scale economies in production and marketing, pressures from distributors and limited space on the shelves. Through careful segmentation and targeting, businesses can often achieve competitive production and marketing costs and become the preferred choice of customers and distributors. In other words, segmentation offers the opportunity for smaller firms to compete with bigger ones. 3. What can be a good segment to target for a facial care product? Why? What can be a compelling consumer insight and your corresponding value proposition? Illustrate your brand DNA diagram and prepare a positioning statement and a tagline. Outline your IMC campaign. (15 points) Segment – Facial products made especially for men Customer insight – There are many facial products available in the market but focused only on female needs, including anti-ageing products. Facial care products for men are very limited as not all facial care companies delve into the market. However, due to the growing number of men getting more conscious of their appearance, they look for products that are made especially for us. This is also because Men’s skin differs from Ladies thus their skin needs differ. Value proposition – â€Å"Complete men’s facial care regime line: products range from facial soaps, scrubs, non-alcohol based cleansers, and facial lotions. Brand DNA: Category – Facial care for men Character – Clear and Clean for the real man Credibility – Should be tested and approved by Dermatologists and Dermatological Institutes Benefit – Complete men facial regimen: Cleans and Clears the face, while moisturizing he skin. Difference – Made especially for men and men’s skin. Positioning statement – The Product For men of different ages and skin types which provides clear and moisturized skin. Taglin – â€Å"Complete facial regimen for the new man†Ã‚  IMC campaign: TV Advertisements, Newspapers, Men’s Magazines, Bus posters. Storyboard – A construction worker, after a long day building a wall is then seen by his co-workers using a facial wash for women. Co-workers laugh when they see the man has a white face after washing. Co-worker gives the man the facial care product for men. 4. Assuming that you are hired as a marketing manager of a publication company. Your primary task is to develop a new magazine that has a strong  market potential. a. What type of magazine will it be? b. Who will be your target market? c. Estimate or extrapolate the market value potential. Hair Salons are almost in every corner, be it commercial or residential area. David’s Salon is one of the successful salon chains in the country that is targeting the mid-end of the market. A new phenomenon however took shape in recent years in the form of F Salon Chain and Reyes Cutters that are charging very low fee for a haircut (45.00-50.00 pesos only). For a while the two salons have mushroomed until they suddenly lost esteem. Assuming, you have the capital to establish a hair salon chain, how will you build your brand? Discuss your 7-P strategies. Make sure you provide a brand name and a tagline for your hair salon chain. (20 points.) Brand name: â€Å"Hairline, Careline† Tagline: â€Å"hairline, gone in 60 minutes† People: Adults with receding hairlines. Only a handful of salons or barbershops really focus on people with hairloss or receding hairlines. Product: A line of hair salons especially for individuals losing hair – services would involve scalp treatments, scalp massages and mainly haircuts that hide hair-loss and receding hairlines. Price: Haircut – Php 150; Massage – 200; Scalp treatments – 200-300 (depending on the treatment: e.g. spa or menthol) Placement: SM Malls, Robinsons malls (non-high end malls) Process: Customers come in and is assisted by the front desk for introduction of services. Customer chooses the service. An expert to that service is provided to the customer. Promotion: Newspaper ads, TV commercials, Flyering activities and on-line advertisements and postings on websites like  SULIT.COM, and/or Coupon websites like CASHCASHPINOY. 6. Making the Value Accessible Distribution: Determine how you want to go to market (i.e. channels of distribution) Placement Channel Marketing Communicating the Value IMC: Determine how you want to promote your product. EMC 7. Discuss Ansoff’s Growth Matrix. Give examples. (10 points) The Ansoff Matrix, designed by Igor Ansoff, classifies and explains different growth strategies for a company. This matrix is used by companies which have a growth target or a strategy of specialization. This tool, crossing products and markets of a company, facilitates decision making. The Ansoff matrix offers four strategies to achieve the objectives. Market Penetration Trying to make a greater share of an existing market with an existing product. This could involve product re-launch or increasing brand awareness. For example, Ipods can be used for file storage as well, this gained them market share in the storage devices market. Product Development Develop new products to target the company’s existing market segments. For example, Coca Cola introduced Coke Zero and Coke Cherry. Market Development Finding or creating new markets by targeting new parts of the market or by expansion into different markets. For example, San Miguel introduced San Mig Zero targeting the health conscious people that wanted lesser calories but still enjoy beer. Product Diversification Seeking to create or develop new products, lines or product ranges for new markets. For example, when Apple introduced the IPad tablet, which revolutionized how people work and manage taske with tap and swipe on the screen. Existing Products New Products Existing Markets Market Penetration Product Development New Markets Market Development Diversification 8. Discuss BCG Matrix/Grid (10 points) The Boston Consulting Group (BCG) Matrix is a simple tool to assess a company’s position in terms of its product range. Question Marks Question marks are products that grow rapidly and as a result consume large amounts of cash, but because they have low market shares they don’t generate much cash. The result is a large net cash consumption. A question mark has the potential to gain market share and become a star, and eventually a cash cow when the market growth slows. If it doesn’t become a market leader it will become a dog when market growth declines. Question marks need to be analyzed carefully to determine if they are worth the investment required to grow market share. Stars Stars generate large sums of cash because of their strong relative market share, but also consume large amounts of cash because of their high growth rate. So the cash being spent and brought in approximately nets out. If a star can maintain its large market share it will become a cash cow when the market growth rate declines. Dogs Dogs have a low market share and a low growth rate and neither generate nor consume a large amount of cash. However, dogs are cash traps because of the money tied up in a business that has little potential. Such businesses are candidates for divestiture. Cash Cows As leaders in a mature market, cash cows exhibit a return on assets that is greater than the market growth rate – so they generate more cash than they  consume. These units should be ‘milked’ extracting the profits and investing as little as possible. They provide the cash required to turn question marks into market leaders. 9. Discuss Product Life Cycle (10 points) The Product Life Cycle (PLC) is used to map the lifespan of a product. There are generally four stages in the life of a product. These four stages are the Introduction stage, the Growth stage, the Maturity stage and the Decline stage. The Four Stages of the Product Life Cycle 1. Introduction: The Introduction stage is probably the most important stage in the PLC. In fact, most products that fail do so in the Introduction stage. This is the stage in which the product is initially promoted. Public awareness is very important to the of a product. If people don’t know about the product they won’t go out and buy it. There are two different strategies you can use to introduce your product to consumers. You can use either a penetration strategy or a skimming strategy. If a penetration strategy is used then prices are set very high initially and then gradually lowered over time. This is a good stategy to use if there are few competitors for your product. Profits are high with this strategy but there is also a great deal of risk. If people don’t want to pay high prices you may lose out. The second pricing strategy is a skimming strategy. In this case you set your prices very low at the beginning and then gradually increase them. This is a good strategy to use if there are alot of competitors who control a large portion of the market. Profits are not a concern under this strategy. The most important thing is to get you product known and worry about making money at a later time. 2. Growth: If you are lucky enough to get your product out of the Introduction stage you then enter this stage. The Growth stage is where your product starts to grow. In this stage a very large amount of money is spent on advertising. You want to of telling the consumer how much better your product is than your competitors’ products. There are several ways to advertise your product. You can use TV and radio commercials, magazine and newspaper ads, or you could get lucky and customers who have bought your product will give good word-of-mouth to their friends/family. If you are successful with your advertising strategy then you will see an increase in sales. Once your sales begin to increase you share of the market will stabilize. Once you get to this point you will probably not be able to take anymore of the market from your competitors. 3. Maturity: The third stage in the Product Life Cycle is the maturity stage. If your product completes the Introduction and Growth then it will then spend a great deal of time in the Maturity stage. During this stage sales grow at a very fast rate and then gradually begin to stabilize. The key to surviving this stage is differentiating your product from the similar products offered by your competitors. Due to the fact that sales are beginning to stabilize you must make your product stand out among the rest. 4. Decline: This is the stage in which sales of your product begin to fall. Either everyone that wants to has bought your product or new, more innovative products have been created that replace yours. Many companies decide to withdrawal their products from the market due to the downturn. The only way to increase sales during this period is to cut your costs reduce your spending. 10. How can Marketing help in nation building? What marketing concept(s) can be more useful for nation building? (5-point bonus) Nation building can be done through promotion of the wonders of the Philippines using advertisements that can be shown using international programs such as CNN and BBC. Commercials that would emphasize the talents of the people, as well as promote investments of foreign companies or investors. Ethics and Marketing Essay Example | Topics and Well Written Essays - 3000 words

Ethics and Marketing - Essay Example Ethics in marketing are very important because marketing is a discipline that interfaces with diverse stakeholders in a society. Marketing is a pivotal aspect of any business that not only extends a discernable and visible interface with customers, but also with a plethora of other entities such as dealers, business associations, shareholders, investors, trade unions, media, etc (Houston, 1994). Hence, marketing is a facet of commerce that has three vital dimensions that are individual, organizational and societal (Houston, 1994). In that context, to talk about ethics in marketing is utterly unfeasible from any singular or narrow perspective. A true understanding of the ethical domain of marketing necessitates a broader and holistic perspective. There exist multiple crucial reasons to facilitate an understanding into and development of most relevant approaches as to inculcate ethics in marketing operations. Most of the organizations existing today are vulnerable to committing ethical foibles and to face an ethical misconduct perpetrated by staff and managers. Even the most well intentioned marketers do face the possibility of taking steps that appear to be ethical on the surface, but are in fact replete with ethical scandals and repercussions, giving way to infamy and legal hassles (Andreasan, 2001). So there exists a dire need to identify the possible risks and chances of misconduct inherent in the marketing operations. At the same time there must exist an attitude of ethical propriety and a commensurate infrastructure within organizations to challenge the ethical misconduct as it springs up, rather than covering up or hiding ethical scandals (Andreasan, 2001). ... The purpose of this paper is to delve on the existing and emerging definitions of marketing and the way they cater to the scope and need for an ethical conduct in the marketing operations. The paper also delves on the ways and means in which the marketers can quantify and evaluate the ethical conduct in the strategies adopted by them. Origins of Marketing Traditionally speaking, marketing is associated primarily with trade or exchange. To put it in simple words, marketing in a way existed since the time mankind learnt to or managed to produce a surplus (Bartels, 1976). Again in a historical context, in the beginning, the generated surplus existed in the form of agricultural produce that was mostly exchanged or bartered for manufactured goods like pottery or textiles (Bartels, 1976). Eventually this exchange of goods got centred on certain specific locations that eventually evolved into what is today known as markets. The concept of trade, as it evolved, allowed and stimulated people to specialize in the production of specific goods and services that they could take to markets to exchange with goods and services required by them (Bartels, 1976). The concept of trade got further transformed with the onset of Industrial Revolution. The economies started to rely less on agricultural produce and the emphasis gradually begin to shift towards industrial production (Bartels, 1976). In the pre Industrial Revolution era, the goods and services were produced on a small scale. However, industrialization resulted in a tremendous boost in productivity due to the mechanization of production operations (Bartels 1976). As a result of these developments, the producers were placed in a position

For each submission, you will add to the document so it contains all of your journal entries. Using no fewer than three peer-reviewed sources, analyze what you have observed within the context of your specialty using appropriate concepts, principles, and theories, giving special attention to observed events that vary from scholarly literature. (30 points) Explain how the problem, situation, or issue was handled in a manner that is consistent and a manner that is inconsistent with the theory, concepts, and principles detailed in the evidence. (30 points) There was a situation during my practicum experience where a day shift nurse was running over at 7.30 pm consequent to a patient experiencing a seizure 30 minutes prior. The day shift nurse could therefore not hand off all her patients as she was behind schedule. When the nurse supervisor was called, the night nurse stated that the situation would cause her to start her shift late and that it was unfair to her. According to Berkenstadt et al. (2008, p.159), the outgoing nurse must inform incoming nurse in regards to "Patient status and care, treatment and service, and any recent or anticipated changes in the condition of the patient". Conversely, bedside shift reports have become the conventional technique of handing off as it increases levels of patient satisfaction (Wakefield, Ragan, Brandt, and Tregnago, 2012). The fact that the night shift complained of unfairness is proof that she was not inclined towards bedside report hand off as an option as dictated by scholarly literature. A research aimed at establishing effective ways for hand offs cited by Philibert (2009, p.261) showed that "Frequent and time-constrained hand offs may frustrate the aims of the duty hour limits". This finding validates the night shift nurses concern that her shift would be affected. In terms of

Is Wind Going Green Essay Example | Topics and Well Written Essays - 1250 words

Is Wind Going Green - Essay Example This means that wind is going green. This article will discuss how wind energy is said to be going green. Wind energy can be defined as the conversion of kinetic energy to a useful form of power. This is achieved through the use of wind turbines, windmills, and wind pumps. Compared to other energy sources, wind power has several advantages hence; it is a better alternative. Wind energy is plentiful, renewable, produces no emissions, and it is widely distributed (Walker & Jenkins, 1997). Therefore, wind power has no effects on the environment, compared to other sources of energy. By 2010, wind energy production was over 2.5% world wide. This is a growth of more than 24% per annum. Wind power generation has become a popular energy generation. However, the construction of wind farms is not universally welcomed. Of late, most of the cities in the world have started taking the initiative to go green. Nowadays, it is clearly evident that most commercial buildings have small wind turbines which are used for power generation. These buildings only use renewable sources of power that are naturally found; therefore, they are referred to as green buildings. The phrase ‘going green’ is now globally recognized as efforts aimed at protecting the depletion of the ozone layer (Rhodes, 2011). Research asserts that state investment tax credits have significantly reduced the burden of individuals who invest in wind power. This credit provided allows the wind investors to reduce their tax obligation by some part of the invested amount in a wind project. A good example of an incentive program is the Orcas Power and Light Cooperative (OPALCO) program (Walker & Jenkins, 1997). This program offers upfront payments for installation of small wind turbines. Moreover, this program has received an unusually high client participation rate. In the recent past, many states have drawn concerns about utilizing renewable energy. Small

Careers in Psychology Essay Example for Free

Careers in Psychology Essay In Psychology there are so many different careers that have gained my interest because I love learning how people function, behave, and how the brain works. The first career that truly gained my full interest is Neuropsychologist. Neuropsychologists are the ones that explore not only the brain system but they also explore behavior and the relationship between the two. This is something that interests me more than I can put into words. One of the reasons I have so much interest in this type of career is because I myself have fetal alcohol syndrome, attention deficit hyperactivity disorder as well as learning disorder. Being able to study the cognitive functions of the brain such as attention, language and memory I believe will eventually help me to understand more of my disabilities and how to work past them. A  Neuropsychologist is also able to evaluate people who have various types of nervous system disorders. They work closely with doctors including neurologists. Illnesses, injuries, and diseases of the brain and nervous system can affect the way a person feels, thinks, and behaves and some of the symptoms may call for a neuropsychologist. Those symptoms are memory difficulties, mood disturbances, learning difficulties as well as nervous system dysfunction. If other doctors are unable to identify the cause of a condition then they bring a neuropsychologist into help determine the diagnosis. In order to become a Neuropsychologist you have to obtain many different skills such as reading comprehension, active listening, critical thinking, social perceptiveness, complex problem solving, writing, speaking, science, active learning, judgement and decision making, instructing, service orientation, learning strategies, monitoring, system analysis, systems evaluation, time management, coordination and persuasion. Each and every one of these skills is just as important as one or the other. By having all these skills it will help To become successful in helping your clients. There is a lot of education involved in becoming an aspiring neuropsychologist. The first step is to earn a bachelors degree which is four years long, after that you complete a masters degree of another two years, then the last and final step is to earn a PHD or PsyD which can take another two to four years. So overall you are looking at spending 8-10 years in college if your heart is truly set on becoming a neuropsychologist. The duties and responsibilities of a neuropsychologist may vary depending on their specialties. Some Neuropsychologists, for instance work primarily as researchers. This might involve studying both healthy humans as well as animals, and those with brain injuries and or illnesses. Neuropsychologists might also work in clinical settings as well. This typically involves assessing and diagnosing patients. This can be done by observing symptoms and using sophisticated technology, such as brain scans. After successfully diagnosing a neurological problem, they can then often recommend a course of treatment which can include therapy, medication or even surgery. The neuropsychologists that are primarily concerned with research might work in private or government research facilities. Some universities might also hire  these professionals to conduct research as well as teac h a class or two. Clinical neuropsychologists might work in a number of different healthcare settings. This can include hospitals, clinics, and physicians offices. Some neuropsychologists might also choose to open private practices and treat patients in their offices or work as consultants. The second career in Psychology which really grabbed my attention more and more as I researched it and read what they do is Rehabilitation Psychologists. Rehabilitation psychologists work with stroke and accident victims and people with mental retardation and those with developmental disabilities caused by conditions such as cerebral palsy, epilepsy and autism. I once worked with a gentleman who had a severe case of cerebral palsy and could not do anything for himself. I was always helping him from the time he woke up in the morning to the time he laid down in bed at night. The sad thing is that from one day to the next I wasn’t sure if he was going to remember me or not. If he didn’t remember me then he would lock me out of his house and he wouldn’t let me back in so most of the time I had to crawl through a tiny window. I believe I would be very good as a Rehabilitation Psychologist for many different reasons. The first reason is that those with disabilities have a soft spot in my heart because I know what its like to be looked at differently for one and for two the willingness to work past the disability is outrageous. Some people with disabilities you cannot even tell they have one because they have learned how to work past it and not let it show. This type of career works closely with public health programs to prevent disabilities including those caused by violence and substance abuse. Rehabilitiation Psychologists testify in court as expert witnesses about the causes and effects of a disability and a persons rehabilitation needs. Rehabilitation Psychologists are uniquely trained and specialized to engage in a broad range of activities including clinical practice, consultation, program development, service provision, and teaching and education training, amongst many others. I am always looking out for everyone else and trying to figure out how I can help them or do something for them to make their lives a little easier on them. In order to become a Rehabilitation Psychologist  you need to have to same type of skills as you would if you were a Neuropsychologist as well as the same path of education. This goes for many of the careers in Psychology. As for where a Rehabilitation Psychologist can work, they can open up their ow n practices, work in healthcare facilities, or in government buildings.

Law Principles in Business Company Formation

Law Principles in Business Company Formation Introduction In a modern capitalist market economy, companies are a familiar part of everyday life. Companies own supermarkets, supply gas, foods, drinks, electricity and products we are depending on. As we all know in Malaysia there are different types of business entities. Local or foreign investors are coming to Malaysia to start a business. Besides, company has been defined as three formal business entities for profit which may be a corporation, a partnership, association or sole proprietorship. However, usually are people thinking the term of company means the business is incorporated, but that is not true. In fact, a corporation usually must use some. In order to incorporate a company, there are two stages that we have to go through, which are, pre-incorporation and post incorporation. In the pre incorporation stage, the promoter is responsible to bring the company into the legal existence and ensure its successful running, and in order to accomplish the obligation he or she may enter into some contract on behalf of prospective company. Promoters are the persons involved in formation of a company. They will undertake the initiative to prepare necessary documents and do other significant works in order to register the company. The principles of law relating to the formation of a company There are various forms of business organizations operating in any given economy. The business structure in use can be defined by the legal framework under which it operates. Therefore, the rules applied to these entities are different. Some of the types of business forms include Partnerships, Sole Proprietorships, and Corporations. Other forms may include entities set up not to make a profit but sometimes for the benefit of the community. Incorporation is when a business decision is made to form a new legal entity which is recognized by law to either undertake a not for profit business or for profit business. The process of forming of a company can be divided into four distinct stages such as promotion, registration or incorporation, capital subscription and commencement of business. Usually, promotion is the first stage in the formation of a company. It refers to the entire process by which a company is brought into existence. It starts with the conceptualization of the birth a company and determination of the purpose for which it is to be formed. A private company as its name implies cannot offer its shares to the general public. The next form of incorporation is a Private Company limited by guarantee. This form of incorporation will have no share capital. Under the Companies Act, a company cannot be limited by guarantee if it has a share capital. This form of incorporation is also limited by shares. It may be referred to as the opposite of a private company limited by shares. This is because it has a share capital and limits the liability of its members to the amount unpaid on their shares. The shares held in such companies can be traded in the capital market in line with listing rules. SEPARATE LEGAL PERSONALITY The principle of separate corporate personality has been firmly established in the common law since the decision in the case of Salomon v Salomon Co Ltd, whereby a corporation has a separate legal personality, rights and obligations totally distinct from those of its shareholders. Corporate personality is a common law principle that grants a company a legal identity, separate from the members who comprise it. On the other hand, it follows that the property of a company belongs to that company, debts of the company must be satisfied from the assets of that company, and the company has perpetual succession until wound up. When a company receives a certificate of incorporation it automatically be a separate legal personality. In law when the company becomes a legal person it means its own right. This essentially means that if one commences business as a limited liability company, then the corporation or company is a legal entity with distinct legal personality separate to that of the owners, members, or shareholders. This is known as the concept of legal personality. The veil of incorporation can be described as being the separation between a company and its members. Due to the separate legal status of a company from its members this is usually very strictly maintained. However, there are certain circumstances when the courts will deny the people who run the company the advantage of hiding behind the corporate veil. In these instances the veil of incorporation is said to be lifted, the barrier between a company and its members is removed so there is no legal separation between them. There instances are however, difficult to predict as the reasons depend on the judges interpretation of fairness or policy or of how a particular statute should be interpreted. In the leading case of Salomon v Salomon Co Ltd, Salomon incorporated his boot and shoe repair business, transferring it to a company. Based on the cases of Mr. Salomon is when he was ran a boot manufacturing business as a sole trader. He and his family were shareholders and then he sold the business to the company. However, the company paid part of the purchase price to Salomon and agreed to pay the remainder over time. To secure its obligation to pay, the company gave Salomon security over its assets in the form of company charge. Effect of the charge, the company’s assets had to be used to pay out Salomon in full before they could applied to pay out the company’s other unsecured as MD. Unfortunately, the company’s business failed, the value of assets was insufficient to pay both Salomon and the company’s other creditors. However, the creditor argued that Salomon should not receive the benefits of charge, because the degree if control exercised over the company meant it should be treated as being his agent or trustee for Salomon in the conduct of the business. Lastly, the charge given by the company to Salomon was valid and he was entitled to be paid his debt even though other creditors would not be paid because of insufficient assets. This is because Salomon was not personally liable and the company was treated as operating the business in its own right which is separate from its controller. Conclusion The law as it is under the English company law will rather impute the principle of separate legal personality to a limited liability company as was the case in the case of Salomon v Salomon than apply the doctrine of lifting the veil. However the law will be ready to go after a person who takes advantage of the principle of the case in Salomon v Salomon to act in a fraudulent or unspeakable manner. It is the intent of the law is to create justice and fairness as it evidenced in both statutory provision and judicial decisions. However the principle of separate legal personality comes with it some vagueness especially when one looks at the exceptions which come with the principle. It is therefore necessary that something is done to reduce if possible eliminate such vagueness.

Streptococcus Pyogenes Overview

Streptococcus Pyogenes Overview The beta-hemolytic bacterium Streptococcus pyogenes formally belongs to the family Streptococcaceae, where it is known to be the most pathogenic bacterium out of its entire genus because of the wide spectrum of diseases it is known to cause. However, Streptococcus pyogenes is a ubiquitous, facultative anaerobic bacterium that can be located in the nasal passageways of some healthy individuals due to its ideal environment for microbes. It is a gram positive bacteria that is classified as a group A Streptococci (GAS) that is unique in its ability to cause a wide range of different onsets of illness in its host such as tonsillitis, scarlet fever, cellulitis, erysipelas post-streptococcal glomerulonephritis, necrotizing fasciitis, myonecrosis and lymphangitis. The name Streptococcus is a derivative from the Greek word Streptos meaning easily twisted or to bend and likewise to pyogenes which is a derivative from the word pyogenic, which is a classification for Streptococci that are compat ible with pus formation. Humans are the common reservoir for Streptococcus pyogenes which is capable of causing an array of different symptoms depending on the direct illness it is inflicting on its host. However, it is commonly known for being the culprit behind Streptococcal pharyngitis (Strep throat), where it can cause a mild to severe sore throat accompanied with a fever, tender/swollen lymph nodes and irritated tonsils. It is highly successful in its fast commute from one person to the next. The transmission can be as simple and innocent as the swap of nasal or throat secretions via airborne droplets or from sharing contaminated food and drinks. Strep throat shows no discrimination in the ages it infects. Although, it tends to be more prevalent in young children. Even though Strep throat is highly contagious it is typically a short lived illness that is easily treated by health care providers with the proper course of anti-biotics. If left untreated or mistreated complications such as rheumatic fever c an arise, which is the bodys over driven immune response to the infection. On the other end of the spectrum Streptococcus pyogenes can cause a more detrimental onset of symptoms with the disease known as Necrotizing Fasciitis (The flesh eating disease). Necrotizing Fasciitis is a rare inflammatory infection that promptly targets the fascia and subcutaneous tissues leaving painful blisters and redness on the surface of the infected areas of skin. The symptoms commonly associated with this disease range from flu-like symptoms, the presence of boil-like blisters, discoloration, infrequent urination and significant swelling of the infected area. It is generally spread through direct contact with open or infected wounds on individuals. Unlike Strep throat, Necrotizing Fasciitis is not as commonly seen or as easily treated. It has a high mortality rate, with 1 out of 4 infected people dying from it. ( SITE). However, healthy individuals who practice proper daily hygiene typically dont hav e to worry about becoming infected with Necrotizing Fasciitis. People who are at a greater risk include those who have had recent surgery, a compromised immune system , abrasions on the skin, diabetes, cancer, have had previous surgery etc. Streptococcus pyogenes is a non-sporing bacterium that is non-motile in nature and can be observed in chains and clumps of cocci that are less than 2  µm in length, producing impressive sized colonies greater than 0.5 mm. There are several different unique M serotypes that contribute to the different diseases caused by Streptococcus pyogenes. Some of strains of M serotypes include Streptolysin O, Streptolysin S, Streptodornase, Streptococcal chemokine protease, Hyaluronidase, Streptokinase, etc. Streptolysin O is a toxin that works on the cell membranes permeability in order to allow for more adequate uptake of larger charged molecules. Streptolysis S†¦Ã¢â‚¬ ¦ Clinical Significance. Streptococcus Pyogenes is self- equipped with many virulence factors that are highly advantageous in its evasion of the hosts immune response in order to make it every bit of possible to establish a productive infection within its host. Initially lipoteichoic aid (LTA) allow for the bacteria to establish an adhering relationship between the cellular surface or mucosa of epithelial cells.(depending on the area of attachment). Protein F (Fibronectin binding protein) comes in and acts as a strong binding reinforcer between the bacteria and its surface of chosen attachment. However, all the while if the bacterium entered through the mouth it may be encountered with secretory IgA antibody in the saliva trying to counter the effects of the antigens on its surfaces to loosen the bacterium. The successful bacterium than quickly begin replicating and colonizing the appealing greater surface area on the tonsils, causing swollen lymph glands and tissue damage as the bacte rium produces compounds like Hyaluronidase to degrade the mammalian cells. The secretions of bradykinins and chemokines result due to the hosts tissue damage which initiate the process of inflammation. The increase of inflammation as well as the rapid ongoing bacterium replication results in the sequence of many immune cells, specifically being neutrophils, macrophages, T-cells, B-cells and dendritic cells. The swollen glands are a direct result of the T -cells increasingly occupying the tonsils while the appearance of yellow pus in the back of the throat is result of the demise of neutrophils. The M protein along with an outer hyaluronic acid capsule aid the bacteria in resisting phagocytosis. All the while pyogenes has established mechanisms to counter specific responses of the host immune response such as T-cell proliferation, counter against neutrophil extracellular traps (NETs), degradation of IgG,etc.

Women and Deception in Homers Odyssey Essay -- Homer, Odyssey Essays

Women and Deception in the Odyssey      Ã‚  Ã‚   As Agamemnon tells Odysseus, â€Å"Let it be a warning even to you. Indulge a woman never, and never tell her all you know. Some things a man may tell, some he should cover up† (Book XI   199).   This is not news to Odysseus, who treats all women with caution ever since he was betrayed by his wife Helen, who acted in a way that defiled all womankind. Agamemnon did not come to this realization all by himself, however; his statement represents the common sentiment that existed throughout all ancient Greece. Even before Odysseus speaks with Agamemnon, he exhibits a similar attitude in his many encounters with women during his long journey home. Every major female character that Odysseus comes across uses deception in one form or another to get the better of him. This being the case, Odysseus fights fire with fire, using his own cunning deception against the evils of womankind.   Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚   The first wily female that Odysseus battles wits with is the goddess Kalypso. The Day :: essays research papers

On a frigid winter afternoon, James Peterson awoke, from his nap, to the sound of what he thought was a gunshot in the near area. He jumped out of bed and scurried to the window to see what happened. To his relief, he only saw two children playing with firecrackers. James decided to put off his Algebra homework and cuddled up on the couch and read one of his favorite books. James loved to read and often read several books a week. This particular book was about a cunning young man named Albert who always seemed to find himself in the most peculiar situations. James was so caught up in one of Albert’s adventures that he lost track of time and forgot he had to pick up his mother from the airport. The sudden shriek of the telephone made James fumble the book in his very hands. James answered the phone. â€Å"H-hello?† â€Å"James Hubert Peterson! Have you any idea what time it is?† His mother sounded as if she were about to explode. â€Å"Oh gosh, I’m really sorry mother, I was reading such an engaging part of my book that I guess I lost track of time!† â€Å"Well, you just get yourself down here right now mister!† â€Å"Yes, mother,† James promised. James proceeded to hop in the car, and drove down to the airport. When he arrived, his mother waved him over to the side of the road. She opened the door and got in with a hurry. â€Å"Well, what are you waiting for, James? Get out there and put the luggage in the trunk, it’s not going to put itself in you know.† James looked up in disdain. â€Å"Yes mother.† The entire car ride home, James tried to ignore the constant yapping of his mother. Every so often, he would think about his books and how he missed them, even though he had only been away for a short period of time. When they arrived home, James unloaded the bags from the car and took them to his mother’s room. He then crept as quietly as he could to his room, where he could escape to fantasy worlds with his books that he loved so much. Before he could take the final step into his room he heard his mother calling his name. â€Å"James come here!† James adjusted his glasses. â€Å"What is it mother?† He walked across the room and sat on the rocking chair, opposite his mother.

American Slavery

Political Points of View: American Slavery In the autobiography, The Narrative of the Life of Frederick Douglass, writes of the Incident when he defends himself against the cruel Mr. Covey. Harriet A. Jacobs also writes in her autobiography, Incidents in the Life of a Slave Girl, of the time she decides to escape from her owners. Spirituals were extremely emotional songs that were often sung by American slaves. Harriet Tubman, a famous â€Å"conductor† or guide that helped free slaves, was interviewed and her stories were published of what she s an abolitionist went through. One similarity they all have is after being pushed too far, they resist against their suppressors. Douglas's way of resisting injustice was defending himself against Mr. Covey. Mr. Covey was a cruel man that Douglass was loan out too. â€Å"l resolved to fight. † what was Douglass determined as he equally hurt Mr. Covey who had beat him previously day after day. I believe Frederick Douglass did the r ight thing even though extremely risky. Harriet A. Jacobs also resisted injustice by escaping her owner, Mr.Flint, and oing to hide at relatives or friends houses, but close enough to keep an eye on her children. â€Å"l groped my way tothe road.. † a quote Jacobs wrote in her autobiography of when she escaped. Even though though risky, Jacobs escaped to try and keep her children safe. knowing that If she took them with her they would give them away or they wouldn't be touched by Mr. Flint since he believed she would return for them. Both went to hardships but found ways and the strength to rise up. Harriet Tubman created the underground railroad. which allowed many salves to scape to the free states.Tubman ,herself a former slave, was the most wanted fugitive of the era and although knowing the dangers still continued leading the underground railroad. Tubman tried to get her brothers to Join her to freedom but they refused. However, she didnt let that stop her. â€Å"She wa lked off alone, following the guidance of the brooks which she observed to run North. † Many American slaves were also known to sing spirituals. Spirituals tended to have codes, or expressed on how Americans slaves really felt about slavery. Spirituals were â€Å"moving and intensely emotional songs. In a sense I feel spirituals created a sad, depressing atmosphere, since many songs were sung that way. However, many were Spirituals were extremely helpful to Tubman and others to become free. Many American slaves were too afraid to rise up, but a few did.

However, there are markets that come near toperfect competition market if it has four following conditions.First, there are so many houses or manufacturers that figure in the market and none of them have a right to alter the market monetary value. For case, the market for rice in Vietnam is so broad. Regardless of one farmer has produced 100 more kgs of rice, the rice market monetary value is still keep the same. This status of each house world so little that they are undistinguished comparative to the market is what makes the MR curve even or absolutely elastic. 2 fringy Revenue curve 3 One house can bring forth a noticeable sum of end product but it is nil compared to the market. As a consequence, the extra end product the house produces can be sold at the same monetary value as smaller measures of end product.Second, it has to be the market where all houses are make outing an monovular merchandise produced in the same manner. When all houses produce an indistinguishable merchandise, they are called solid merchandises. 4 The premise about same merchandises means that all houses will sell their merchandises at the same monetary value. If all the merchandises from different houses are indistinguishable, clients will lead houses by taking the lowest monetary value.
